These terms of use (the “Terms”) govern access to and use of the Kapoopa platform (the “Service”), available on kapoopa.app and through the mobile app, published by AKORIT SARL, a company incorporated under Ivorian law and registered with the Abidjan Trade and Personal Property Register under number CI-ABJ-2018-B-19401 (“AKORIT”, “we”).
The Service allows its users to create challenges with a financial reward and to take on challenges created by other users. Registering, signing in or simply using the Service constitutes full and unconditional acceptance of these Terms and of the privacy policy. If you do not accept them, you must stop using the Service.
Challenge: a task described by a Creator, with a Reward, that any Participant may try to complete.
Creator: a user who publishes a Challenge and places the corresponding Reward in Escrow.
Participant: a user who tries to complete a Challenge published by someone else.
Reward: an amount of money set and funded by the Creator, paid to the Participant whose Proof is approved.
Escrow: the mechanism by which the Reward is locked on the platform from the Challenge's publication until it is resolved.
Proof: a photo, video, screenshot or any other item submitted by the Participant to show the Challenge was completed.
Wallet: the CFA franc balance linked to the account, credited with deposits, winnings and bonuses, and debited with Escrows and withdrawals.
AKORIT provides a technical service connecting Creators and Participants and securing Rewards. AKORIT is neither the author, the organiser nor the guarantor of the Challenges: each Challenge is designed and offered under the sole responsibility of its Creator, and completed under the sole responsibility of the Participant.
AKORIT is not a bank or a payment institution. Payments are carried out by licensed providers (including Flutterwave and mobile money operators). The Wallet is not a bank account: it bears no interest and is not a deposit of funds within the meaning of banking regulations.
Challenges are not gambling or games of chance: participation is free, no Participant stakes any money, the Reward is fully funded in advance by the Creator and it is awarded based on the actual completion of the Challenge, assessed on Proof, never by random draw.
Registration is reserved for individuals aged 18 or over with legal capacity to enter into contracts. Each person may hold only one account. Users undertake to provide accurate, up-to-date information and guarantee its accuracy to AKORIT.
Users are solely responsible for keeping their credentials confidential and for any action taken from their account. They must report any unauthorised use without delay to info@kapoopa.app. AKORIT cannot be held liable for any loss resulting from the use of a user's credentials by a third party.
Withdrawing funds requires identity verification (know-your-customer, “KYC”). Accepted documents are the national identity card, passport and driving licence, valid and in the account holder's name. Users photograph, with their device's camera, the front of the document, its back (except for passports) and their face (selfie). AKORIT may refuse a verification, request additional documents or cap amounts, in particular for unreadable photos, expired or non-compliant documents, or suspected fraud.
The Creator freely sets the Challenge's content, Reward, number of spots and deadline, in compliance with Article 8. Every Challenge is reviewed by AKORIT before going live; AKORIT may refuse, suspend or remove a Challenge at any time without having to give reasons. A refused Challenge is refunded to the Creator in full.
The Reward (and, where applicable, the commission) is debited from the Creator's Wallet and placed in Escrow upon publication. The Participant submits their Proof before the deadline or, where applicable, before the time limit that starts when they take on the Challenge. The Creator may require a starting proof: it is time-stamped when sent and compared with the final Proof; a missing, inconsistent or forged starting proof justifies rejecting the final Proof.
The Creator reviews each Proof and approves or rejects it, in good faith and in light of the Challenge description. At the deadline, Proofs still awaiting review are deemed approved within the available spots, and the others rejected; unused spots are then refunded to the Creator. A Creator who does not want a Proof approved must therefore reject it before the deadline.
A Participant whose Proof is rejected may contest the rejection once. The dispute is decided by an AKORIT moderator based on the file; this decision is final and binding on both parties. The funds concerned remain in Escrow until then.
Deposits are made through Flutterwave and credited once the payment is confirmed by that provider. AKORIT charges a commission on each Challenge, whose rate is shown before publication (paid by the Creator or deducted from the Participant's Reward, as the Creator chooses). AKORIT may change its fees at any time; new fees apply to Challenges published after they take effect.
Withdrawals are available via Orange Money, Wave or Mobile Money (from 1,000 FCFA, processed within a few hours at most) or bank transfer (from 50,000 FCFA, within 3 to 7 business days). Accounts outside the CFA franc zone can only withdraw by bank transfer, from 100 in the account's currency. Transfer fees, whose rate depends on the method chosen, are deducted from the amount withdrawn; the net amount is shown before confirmation. Users are solely responsible for the accuracy of the payment details they provide: a transfer made to incorrect details they entered cannot be refunded by AKORIT. Timeframes depend on providers and are indicative only.
Wallets, deposits and withdrawals are held in CFA francs; amounts shown in another currency are indicative. AKORIT may at any time correct any erroneous entry (double credit, technical error, payment cancelled or disputed with the provider) by debiting or re-crediting the Wallet concerned.
Users are solely responsible for declaring and paying any taxes and contributions due on amounts they receive through the Service.
AKORIT may offer a referral programme: when the referred user completes their first Challenge, a bonus whose amount is shown in the Service is credited to the referrer (and, where applicable, to the referred user). No bonus is due for a Challenge created by the referrer themselves. AKORIT may change, suspend or end this programme at any time, without affecting bonuses already paid in good faith.
Once a Proof has been reviewed, the Creator and the Participant may rate each other. Reviews must be honest, based on the actual experience and free of insults; AKORIT may remove any review that breaches these Terms.
The following are prohibited in particular: Challenges or Proofs that are illegal, dangerous to anyone's health or safety, sexual, discriminatory, hateful, violent or infringe third-party rights (privacy, image, intellectual property); Challenges involving minors; any attempt at fraud, manipulation or collusion between accounts (in particular to obtain a Reward or referral bonus); creating multiple accounts; submitting forged or borrowed Proofs; money laundering or financing of illegal activities; harassing a user; any interference with the operation or security of the Service (bots, data scraping, circumventing technical measures).
In the event of a breach or reasonable suspicion of a breach, AKORIT may, without notice or compensation: remove the content concerned, cancel a Challenge, an approval or a bonus, block withdrawals while it investigates, cancel or recover amounts obtained fraudulently, suspend or close the account, and report the facts to the competent authorities.
Users remain the owners of the content they publish (Challenges, Proofs, messages, reviews, photos) and guarantee that they hold all the necessary rights and permissions, including those of any identifiable people shown. They grant AKORIT a free, non-exclusive, worldwide licence, for the duration of the rights, to host, reproduce, adapt and display this content for the operation, moderation and promotion of the Service. AKORIT does not systematically review this content in advance but may remove it at any time.
Messaging allows users to talk with a Challenge's Creator. Messages must remain respectful and related to the Challenge. Offering a payment or arrangement outside the platform is prohibited: funds paid outside Kapoopa have no protection and AKORIT accepts no liability for them. In the event of a report or dispute, moderators may read the messages concerned.
Users agree to receive notifications related to their account (Proofs, winnings, withdrawals, messages, reviews), by push notification, email or within the Service. They can turn off news and announcements at any time in the app settings or their profile. The Service may display advertising, as described in the privacy policy.
The Service is provided “as is” and “as available”. AKORIT strives to keep it accessible but does not guarantee that it will be free of errors or interruptions, in particular for maintenance, updates, or the failure of a provider (host, Flutterwave, operators, Google, Apple, telecommunication networks).
Each user takes on Challenges at their own risk. AKORIT cannot be held liable for any physical, material or moral damage suffered while completing a Challenge, for whether a Challenge complies with the law applicable in the user's country, for the accuracy of information published by users, or for relationships and disputes between users, subject to its moderation role described in Article 5.
To the fullest extent permitted by law, AKORIT shall not be liable for indirect damages (loss of opportunity, earnings, data or reputation), and its total liability to a user, for all causes combined, is limited to the commissions AKORIT received on that user's Challenges during the twelve (12) months preceding the event giving rise to the claim. These limitations do not apply in the event of gross negligence or wilful misconduct by AKORIT, or to damages that cannot be excluded by law.
Users shall indemnify AKORIT, its managers and employees against any claim, action, judgment, fine and costs (including legal fees) arising from their content, the Challenges they create or take on, their breach of these Terms or of the law, or their infringement of a third party's rights.
AKORIT may suspend or close any account in the event of a breach of these Terms, fraud or a legal obligation, after notice where possible and without notice in the event of a serious breach. Lawfully acquired balances remain withdrawable once any investigation is closed and identity is verified, minus amounts owed to AKORIT or obtained fraudulently.
Users may delete their account at any time (see kapoopa.app/suppression-compte). They must withdraw their balance first: the balance of a deleted account can no longer be withdrawn. Ongoing Challenges are resolved under these Terms. Data is handled as described in the privacy policy.
The Kapoopa brand, logos, interface, software and content of the Service (excluding user content) are the exclusive property of AKORIT. Any reproduction, extraction or reuse without written permission is prohibited. AKORIT grants users a personal, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
These Terms are concluded between the user and AKORIT only, and not with Apple Inc. AKORIT, not Apple, is solely responsible for the Kapoopa app and its content. Apple is not a sponsor, organisers or partners of the Challenges, and are in no way involved in their creation, running, approval or the payment of Rewards.
For the app downloaded from the App Store: the licence is personal, non-transferable and limited to Apple devices that the user owns or controls, as permitted by the App Store Usage Rules. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, the user may notify Apple, which will refund the purchase price, if any (the app being free, no amount is due); to the maximum extent permitted by law, Apple has no other warranty obligation. AKORIT, not Apple, is responsible for addressing any claims relating to the app (product liability, failure to conform to any legal or regulatory requirement, consumer protection, third-party intellectual property infringement). The user represents that they are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against the user.
AKORIT shall not be liable for failing to perform its obligations as a result of force majeure or an event beyond its reasonable control, including network or power outages, failure of a payment or hosting provider, cyberattacks, decisions of an authority, epidemics, natural disasters, unrest or strikes.
AKORIT may develop the Service and change these Terms at any time. Users are informed of any material change by any means (notification, email or message in the Service); continuing to use the Service after being informed constitutes acceptance of the new terms. Users who do not accept them may delete their account.
If any provision of these Terms is held void or unenforceable, it shall be deemed unwritten and the other provisions remain in force. AKORIT's failure to enforce a breach does not waive its right to do so later. AKORIT may assign its agreement with the user to any entity that takes over the operation of the Service. These Terms, the privacy policy and the legal notice constitute the entire agreement between the user and AKORIT. In the event of any discrepancy between the French version and a translation, the French version prevails.
These Terms are governed by Ivorian law and the OHADA Uniform Acts. In the event of a dispute, users undertake to first send a written complaint to info@kapoopa.app so that an amicable solution can be sought within thirty (30) days. Failing agreement, the competent courts of Abidjan (Côte d'Ivoire) have exclusive jurisdiction, subject to mandatory provisions protecting consumers in their country of residence.
